A Modern Award is a legal document that sets out the minimum pay rates, penalty rates, allowances and conditions for employees in a particular industry or occupation. Most employees in Australia are covered by a Modern Award, and as an employer you're legally required to meet those minimums. Understanding which Award applies to each member of your team, and what it requires, is one of the most important things you can get right as a small business owner. At minimum, a compliant Australian employment contract should include the employee's role and classification, their pay rate, their hours of work, which Award applies, leave entitlements, and the terms of termination. Unfair dismissal occurs when an employee is terminated in a way that is harsh, unjust or unreasonable, or without a valid reason or proper process. In Australia, employees who have completed the minimum employment period, 12 months for small businesses with fewer than 15 employees, can make an unfair dismissal claim to the Fair Work Commission. The best protection is a clear performance management process, documented conversations and following correct termination procedures. Redundancy occurs when a role is no longer required. This can be due to restructuring, business downturn or technological change. It's not about the person, it's about the position. Termination for cause occurs when an employee's conduct or performance justifies ending the employment relationship. Notice periods depend on the employee's length of service and their employment contract or applicable Modern Award. Under the National Employment Standards, minimum notice periods range from one week for employees with less than one year of service, up to four weeks for employees with more than five years.
